In my opinion he’s cooked. I wouldn’t have shot just for the simple fact that my partner was 3 feet from the driver. Why shoot? Because you’re mad she’s not obeying your commands? Now the agent has to deal with this huge mess that will take 2 years to resolve. .

I guess we’ll see how it plays out.

He will absolutely not be charged with murder. Manslaughter is possible.

Also, the fact that he was drawing his weapon before the car was in drive means nothing. He’s allowed to draw his weapon AND point it at the driver.

Pulling the trigger is a whole different thing, though.
