Moral failure to be sure. But I'm with paver that legally there shouldn't ever be anything wrong with McQuerries actions. In fact I am comforted by this fact.

Anyone who would criminalize this conduct (non-action) is acting emotionally without proper analysis for what this would mean for the rights of all citizens in this country. Sorry little boys. I hope I would have the courage to report this crime further (or even stop it in action) but I am comforted by the fact that if I don't I have zero (legal) culpability.

Absolutely I would be happy. I did 3 years in the military and this is what we did. If you are a corporal you report to the sergeant and if you are a captain you report to the major. A corporal never goes to the major directly. And I actually saw something I shouldn't have seen in the showers.

I'm not sure what you're getting at there but I wouldn't be thinking about it that much. I just break it up. I couldn't not. I really doubt you would have to do much more than shout Hey! I completely agree with the legal vs. moral debate. I don't think he should be punished by the court of law. His ostracism from the general public is just punishment in my opinion.
