I think it was the stalking charges that were dropped that caused the death penalty to come off the table. But yeah, still gonna be a homicide charge of some sort.

If Im understanding correctly, 2x federal stalking charges still in place because it was interstate, judge ruled firearm and murder with firearm charges NOT Federal, just state.

So he'll still he tried for murder and all that jazz but only in NY, where they don't have death penalty.
